Attorney Karen Daley Receives Opinion from Court of Appeals

Karen Daley, an attorney from our Livonia office, recently received an Opinion from the Court of Appeals affirming the dismissal of claims against our client, a police officer. The complaint alleged a claim for federal malicious prosecution based upon false statements made by the officer, as well as state law claims of false arrest/imprisonment and intentional infliction of emotional distress. The Court of Appeals concluded that there was no evidence that the Officer's statements were made deliberately or recklessly, and also agreed with Ms. Daley’s argument that there would have been probable cause to arrest the Plaintiff even without the Officer's allegedly false statements. As a result, the Court concluded that the Plaintiff’s claims were properly dismissed.
