Sarah Overton, an attorney with the Firm’s Riverside, California office successfully represented a local community college in a discrimination case issued by a job applicant. In the case, a male employment seeker failed the college’s physical and then sued the college for discrimination. Overton proved in court that proper procedures for hiring were followed by the college and no discrimination on any level existed, especially when she introduced evidence that the plaintiff never at any time had specified he was disabled or needed any accommodation.
Refusing to settle the case out of court, Overton took the case to trial to stop any other potential employees who might sue the college because of any alleged inability to perform the job they applied for, possibly costing the community college district thousands of dollars. Overton and CMDA received a unanimous verdict from the 12 members of the jury.
