Law Enforcement Practice

Cummings, McClorey, Davis & Acho, P.L.C. has a team of attorneys, one a former police officer himself, with the background and expertise needed to provide police officers the aggressive representation they need and deserve in today’s reality world. Police officers have to make life-and-death decisions quickly. When those decisions are questioned, they have the right to have an experienced attorney represent them.  Attorneys from our Law Enforcement Defense practice area represent police officers, departments and municipalities with a high-level of competency in cases involving:

  • Use of force/taser/shootings/wrongful death
  • State and Federal claims of false arrest, malicious prosecution, selective enforcement, wrongful forfeiture or other civil rights violations
  • In-custody death or injury
  • Investigations
  • Interrogations
  • Injunctive show cause proceedings
  • Employment related matters, including trial board hearings
  • Grievances concerning pay, leave, transfers and promotions
  • Retirement disability, ADA, FMLA and similar issues
  • Contract Negotiations
  • Discipline Representation
  • Appeals
Through handling countless police misconduct matters, our Firm knows why other officers and departments are losing cases or are being forced to settle. We know what makes a good witness and why many officers do not make good appearances at depositions or at trial. We have developed a winning strategy to prepare officers for their depositions and testimony at trial.

The number of litigated cases against police officers, departments and municipalities has skyrocketed. Juries are granting enormous verdicts in these cases. The juries are often out to punish the officers as wrongdoers, but in many cases the officers are blameless. The presentation of facts did not educate the jury as to the dangers and decisions an officer is forced to make in a split second. Our team is very aggressive in pursuing discovery against the claimant. We take a hard-line position limiting whatever discovery is sought by the plaintiff’s attorney. The more we limit a plaintiff’s investigation into the background of the officer and department, the better we position our case for a successful dispositive motion or trial. Attorneys in our Appellate, Research and Writing practice areas play a significant role in the Firm’s success in handling police misconduct cases.
