In the recent case of Hi-Lo Heights Lakefront Property Owners Association v Columbia Township, the Court of Appeals was called upon to decide the rights of members of a subdivision to use a park which provided lake access to a lake that the subdivision bordered. The case arose when owners of the lots located immediately adjacent to the lake sought to limit the use of the park by owners whose lots were not located immediately adjacent to the pack. The Court of Appeals ruled that none of the lot owners of the subdivision were riparian owners, because the lots, as originally platted, stopped short of the water. Because none of the property owners were riparian owners, the right to use the park are the same for all the property owners in the subdivision. |
